HOAs and SB 1211
Civil Code §4751 voids HOA restrictions that effectively prohibit ADUs.
Civil Code §4751 voids any HOA rule that "effectively prohibits or unreasonably restricts" the construction of ADUs. This applies to SB 1211 ADUs as it does to all other ADU types.
HOAs may impose architectural-review standards, but only objective ones (color, materials, setback). They cannot block construction or impose size caps below state minimums.
